    2. You are under the age of 18

    By submitting this application to the Morgan County Prosecutor’s Office / Deferral Program, the applicant affirms the following statements are true and accurate (Not applicable for DWS infractions). (1) I have not been convicted of operating while intoxicated within the last 2 years; (2) I have not been convicted of a driving felony in the last 5 years or any Class A or B felony or Level 1 or 2 felony; (3) I am not currently on a deferral program; (4) I have never been adjudged a habitual traffic violator (5) I have not received more than two traffic infractions in the last 12 months. (6) The Defendant states he/she does not currently have a Commercial Driver's License (CDL), is over the age of 18 yrs and not currently on probation with the Bureau of Motor Vehicles (BMV).
